Yea I think this is very much the case. Its too bad. I would guess the Ledger camp is quite protective of his likeness, understandably.

I pre-orderd mine through Toy Square not fully sold on Batman yet but I'll probably cave and order him.
I think overall its a great figure, the head may not be 100 percent Ledger but I dont see 100 percent Christan Bale in the Wayne Sculpt either.
The DC Direct Joker head may look more like Ledger but I much prefer the HT sculpt it has more life to it.

Just placed an order for the Joker through my local retailer!
I do agree, Heat Ledger likeness isnt really there, but the figure still looks like a cool representation of the character in the movie.

Look what I found.
I find it interesting that they use promotional pics to develop their products. Wonder if they get any additional photos from WB.
