Portsmouth Theatre Owner Hires Columbus Attorney to Sue City for Harassment

Portsmouth, OH (HNN) -- The owner of the gutted Columbia Music Hall in Portsmouth, Ohio, has hired a Columbus, Ohio, counsel to sue the city for harassment by the police department -- in particular Chief Charles Horner.
 
The latest in a string of events occurred Wednesday, May 14, 2008, involved a vehicle that sat parked on Fourth and Market Street while Lee Scott attended an auction. Two detectives apparently watched the unattended vehicle, then, hours later when Scott returned, asked to search it. Scott locked the truck and demanded that a search warrant be first obtained.
 
Scott has written on a forum that the vehicle search “is/was never in my name” and had been “unattended for 6.5 hours.”
 
According to a release by the Portsmouth police as printed in the Portsmouth Daily Times “officers had reason to believe the vehicle was being used for drug activity, and the police K-9 unit was called to conduct a search on the scene and alerted to the presence of drugs. After the search warrant was obtained, officers were given permission to tow the vehicle to TST Towing in Portsmouth, where they would enter the vehicle to conduct their search. During their search, officers reported finding parts of a cigarette believed to be marijuana, two packs of rolling papers and a green leafy substance also believed to be marijuana.”
 
The vehicle was returned to Scott and no charged were filed.
 
Witnesses at the scene revealed that representatives of the Bureau of Alcohol Tobacco and Firearms and Portsmouth Fire Department were also on hand.
 
Scott told the Times, “ This makes five documented cases that Police Chief [Charles] Horner has come after me, he’s harassed me, he’s towed my vehicles away, he’s put tickets against me and not one of them have ever made it to court.”
 
One of the citations concerned failure to obtain a permit for a dumpster in which to place debris from the Columbia fire.
 
Scott has been fighting the governmental establishment in the city for years, including during the time of the renovation of the Columbia Theatre and re-opening of it as the Columbia Music Hall. He and others had been active in a group that successfully recalled then Mayor Greg Bauer from office. The group had opposed acquisition of the Marting’s Building by the city and has suggested that petitions with 300 names will be gathered to implement citizen directed action on city charter alterations.
 
The vehicle search came just hours after Scott had spoken with current Mayor Jim Kalb about plans for the future of the Columbia site. After removing the rear wall, he had relented and decided to rebuild from the front façade which includes the previous balcony, but had stated that any interference from the city would lead to the whole site becoming a parking lot.
 
A previous city beat reporter for the Daily Times, Jeff Barron, had been fired by the paper after writing stories concerning council, the Columbia, and a specific drug arrest which resulted in complaints to the newspaper.
 
Scott has stated that James Banks of Columbus, Ohio, will file the complaint. Banks is not a stranger to Portsmouth litigation. He represented convicted murder John Adams in an appeal where the court determined that the defendant did not receive a fair trial due to the court reporter filing four different transcripts (all different) with missing, incomplete and possibly inaccurate portions . Adams had previously worked as a psychiatrist at Marshall University. He had been convicted of murder related to the husband of a patient he had treated.
 
Banks also represented an officer in a dispute with Chief Horner that eventually made its way to the Ohio Supreme Court.
 
Scott has maintained that certain city officials, most under the direction of Horner, have harassed him before and after the Columbia fire. The fire occurred about 12 hours after Scott had been quoted in the Times as declining to pay Horner extra money for security/protection of the business. Almost immediately after the fire, Scott was cited for not obtaining a permit first before bringing in a dumpster to haul off debris.
 
Following a multiple agency investigation of federal, state and local law enforcement officials, the fire at the theatre was determined to be arson. No arrest has been made.
 
The Columbia restoration had been one of the keys to redevelopment of downtown Portsmouth, Ohio. The nearly 100 year old theatre had a family friendly atmosphere for its music performances.

One other thing for Lookin-----Why did the dog hit on my truck? Maybe he was hungry and smelled the open dog food on the right rear side where he scratched? After all, is that not what they do...give them a piece of food for finding anything as a reward?

I keep a bag of dogfood for the hungry dogs dropped off on Careys run hill by all the lowlives that do such in the back of trucks I drive to my country home. Poor drug dog was hungry I guess! Who else works to get food alone!

Give me a break! Those dogs are HIGHLY trained animals. They do NOT alert the officers that they have found food by scratching a vehicle. They only alert for narcotics. So unless your Kibbles was fortified with Oxycontin or cocaine, I don't believe that's why your vehicle was scratched. And neither does anybody else. They are all laughing at your stupidity. Can't your hear them?

Do you feel the PPD over stepped its boundary performing this search?


What about the other agencys who showed up to assist processing a Reefer Roach Warrant?

What does the AFT & E, State Fire Marshall, and City Fire Department have to do with impounding a vechicle looking for "drug activity" ???

lookim, I have seen instances where the dogs were trained with drugs hidden in tennis balls. Of course the dogs always alerted on tennis balls thereafter. You can trust a dog if you want to, but if you ever owned one, you know why they call them dumb animals.

W Leedom, since we've never met or even really discussed anything on here at length, I can't say that I know much about you. But surely, you don't really believe that a K-9 alerted on that truck because there was a bag of dog food in the back. Even though you can go one page back on this very thread and read my answers to every question you just asked, I will re-post them just for you, LD.

And another thing, how come Mrs. Lee Scott isn't the attorney suing the city? Is she not good enough to take on your own case? And let's get real here, if the city HAD a search warrant - no matter how you claim it was obtained - you can not win this case. Also, I heard you bee-yatching and moaning that your truck - excuse me, your brother's truck that you paid for - was scratched during the search. Do you know why? The dog WILL scratch your vehicle when he is alerting the officers of drugs. That's their way of signaling they've found something. I'm sure your wife has a law book in her office with that very precedent in it. I can't remember the name of the suing party but it was against the state of Texas I know; that someone sued the county because their K-9 scratched his new Corvette during a drug search BECAUSE it was alerting of drugs. And BECAUSE drugs WERE found, the appeals court ruled it was NOT the fault of the county, but the plaintiff for knowingly transporting drugs on public roads. So, just like every other time you've screamed lawsuit at those guys, you're gonna come up a loser with your foot down your throat.

Yes and No. The police DO have a right to search with 'reasonable cause'. Mr. Scott's odor apparently was reasonable cause. Also, whether it's true or not, Scott admitted to "smoking one" prior to encountering the officers at his truck. But as I also stated in my previous post ... It's been my opinion that - right or wrong - Lee Scott is the cause of 100% of any 'harassment' he suffers at the hands of our elected leaders, be they corrupt or virtuous.

The answer to that one is just as simple. The PPD and its chief probably did abuse their power in bringing in the other agencies. But why? Why would they want to waste all that man-power and time on one man and a suspected drug-trafficking search? Let me tell you why ...

I've read this board almost since its inception and in that time I have heard Lee trash-talk nearly every politician, (flip-flopping his love and adoration for some, i.e. Jim Kalb) every publication, and most of the families in Scioto County.

I do have to add that, while the PPD did IMO abuse its power to some degree, the search itself seems perfectly legal and within reason. If somebody is dumb enough to say 'Um, I just smoked one, that's why I smell like pot' (paraphrased of course), then he or she needs to be searched. And if no drugs are found, they ought to be given some.

Lee made his bed through years of countless attacks on people, the elected officials and others. Nobody, and I mean nobody, would sit idly by and just let so many slams - lies or truths - just go without some kind of rebuttal. And he's the biggest hypocrite I've ever encountered outside Jim Bakker. Screaming that everyone in town is a crook, when he himself is right in the same trenches with just as mud on his hands as the rest of em.

So don't tell us the sheets are twisted or the springs are starting to come back through and stab you in the ass. You should have bought that new Serta when you had the chance.
