Indiana Dunes National Lakeshore question
My current understanding on the legality of topless sunbathing is that it is legal in all U.S. national parks, but I would certainly welcome any comments or confirmations on this matter.
This, I assume, would mean that it is ok to lie out topless along the Indiana Dunes National Lakeshore... Can anyone confirm this. Trip reports on topfreedom.com suggest that it has been done, but does anyone recommend any places to go? (I have never been to Indiana Dunes)

Technically true but you can still run into problems in some places. First, remember that not all of the Dunes is federal and the part by the beachhouse is state-owned. Having said that, I have seen topfree and nude use away from the beachhouse even in the state area. I would suggest keeping a cover nearby when the ptrols come by assuming they still do that. (I haven't been there for a while.)

My understanding is that it is legal to be totally nude (and therefore topless as well) on Federal land, since there are no federal statutes against simple nudity. I spend a lot of time on a legal nude beach here on Long Island - legal because it's on Federal land - and in conversations with the patrolling police officers have been given this explanation.
However, I do believe that local municipalities have the right to pass an ordinance against nudity or toplessness which may supercede the Federal statutes. You might want to check with an attorney in your location about this, or simply call the local police to get a reading on what's OK.

I don't know about the legal issues involves but it should be remembered that only part of the Indiana Dunes is federal. A big chunk is also state-owned.

To any one of you...has anyone visited the Dunes in '05 yet? If you have did you witness any of these activities, toplessness or nude or thongs (women or men), while there?
And...Gary, you mention you have seen topfree and nude use away from the beachhouse. What direction from the beachhouse was that? I'm guessing it was to the right (north) of the beachhouse because to the left not to far down is Porter Beach and then private beaches of Dune Acres.

My wife and I enjoy the area between Mt. Baldy and Central Beach, which is within the national lakeshore. The two are nearly two miles apart and the distance between can be hiked without much difficulty.
Occasional, discreet top-free use starts about 1/4 mile west of Mt. Baldy, and continues from there, past a shallow stream, and on to a blowout about 1/4 mile east of Central beach. Nude use is occurs within the blowout, which is an effort to climb it, but once up there, you'll have it to yourselves (or maybe a few other like-minded people on weekends).
Our preference is in the area within about 1/4 mile of either side of the stream, back from the shoreline, either near where the beach grass starts or even further back. This is away from the casual beach hikers (who usually stay near the shoreline) and offers a view of anyone approaching with sufficient time the wife to roll over or cover up.
Another area with occasional topfree and nude use is at the far east end of the beach from Mt. Baldy.
We don't know about the legality. Indiana does have anti-nudity laws. Although we have not observed enforcement in this area, we also don't want to risk being a test case.
A few years back, they did a "beach nourishment" project which widened the beach by about 50 yards. Prior to then, some of the areas were quite narrow and difficult to negotiate, and nude use was quite common. Now that the beach is wider, increased foot traffic necessitates greater discretion.

Thank You. I happened to visit Kemil Beach this past weekend. I went for a walk on the beach heading south towards the Dunes Park. While walking I spotted two guys in thongs. One was about two thirds up from the water not in the dune grass but the other was "hiding" in the dunes and grass. That guy kept making his way farther north towards Kemil Beach walking only in the dunes and grassy area while I was there. Kind of wierd if you ask me. It's good to know that topfree and nude use occurs throughout the National Lakeshore. I might have to try out the area you are talking about and see if I am more comfortable in my thong near that area. F.Y.I. 28 y/o male w/ g/f of almost 5 years.

I think that everyone here posted some fairly accurate info on the dunes. First let me say that I being a mom in my thirtys, as well as a couple of my friends often go topless in the area East of Central Beach, which does not have life guards and is not at all crowded. We've seen other topless women now and then, but everyone is on edge when a stranger aproaches.
Reason being; while technically the National Lakeshore is Federal Land, Indiana Laws can be enforced within the park. Indiana Law strictly forbids toplessness as well as thongs. Many people assume they are safe in the National Park, so therefore you will see occational toplessness, but only on the remote beaches. For the most part, as long as no one objects to you, you're alright, but if a park ranger nears, better roll over. I've not heard of any citations for toplessness, but they are writing them for people going nude, thinking that Indiana Laws won't apply. This comes from a park ranger himself.

We were at Indiana Dunes last week - we took a vacation in Chicago but decided on a nice day to visit. It was lovely - a great beach and lots of very high dunes - hills of sand! We did go west of Mt. Baldy and I laid out topless in my thong and hubby wore his thong - we did walk a bit to get to a fairly secluded spot but we did encounter some beach walkers strolling by and they did not mind at all. And we hiked up one of those high dunes and found where we could go nude. We enjoyed it very much and if anyone is in that area, I'd recommend it as a place to go topless or nude!!

The legal situation as described here is probably correct. At most National Parks there is what is called "concurrent jurisdiction," which means that federal authorities may enforce both federal and state law. I would expect that ther is concurrent juridiction at Indiana Dunes National Lakeshore.
